When you create a revocable living trust, as the settlor, you need to name a trustee to manage and administer the trust’s assets. You can name yourself, another individual, or a professional trustee. Generally, when people think of professional trustee services, they think of a bank or financial institution’s trust department or a recognized trust company. Banks and trust companies can be costly and may require a high volume of assets as a threshold requirement. When working with your Trust and Estate Planning Attorney, a professional trustee, such as MaxCorp may be named. You may not have the time, desire, or experience to manage and administer your revocable living trust by yourself during your lifetime. As a professional trustee, MaxCorp has the responsibility and fiduciary duty of managing and administering the trust according to the legal terms of the trust. If you decide to be your own trustee or name another individual as trustee, MaxCorp can be named a professional successor trustee. As a successor trustee, MaxCorp will step in only when you can no longer act due to incapacity or death and/or when other named individual trustees decline to serve.
Naming MaxCorp as trustee or successor trustee ensures objective exercise of discretion, continuity, avoidance of conflicts of interests, protection against the misappropriation of funds, and professional management of trust finances and assets. As a professional trustee or successor trustee, MaxCorp’s only interest is to carry out and honor the wishes of you and your trust.
If you decide to name MaxCorp as trustee or successor trustee, personal representative, or agent in your trust and estate documents, please call our office to inform us of this decision. You can always change your documents and choose not to name MaxCorp in the future. However, to ensure the highest quality and cost-effective services if and when MaxCorp needs to provide its services, we kindly request that you advise us of your decision to name MaxCorp, provide us with a copy of your documents, and complete our client intake form.
