Who Provides Referrals to MaxCorp?
If you are in the planning stage for your Trust, Will and other estate planning documents, and if it is suitable to name a professional trustee or successor trustee, your Trust and Estates Planning Attorney may refer you to MaxCorp as a potential option. In this case, please contact our office, fill out a Client Intake form, and set up a meeting with the Executive Director to discuss your circumstances.
If you name MaxCorp as successor trustee, successor personal representative, or power of attorney in your Trust and Estates planning, please provide copies of those documents to MaxCorp and fill out a Client Intake form. MaxCorp will check in with you annually thereafter to see if there are any updates or changes, so that MaxCorp has current information for you and can readily step in when the time comes.
If you have a financial or investment adviser who provides advice on how best to protect your assets and ensure security for your family after you pass, your financial adviser may refer you to a Trusts and Estates Planning Attorney. Depending on your situation, your financial adviser may also recommend MaxCorp to serve as a professional trustee, conservator/guardian, and/or personal representative. Generally, if there are IRAs, Trust investment accounts, or other assets managed by your financial adviser, MaxCorp will continue to coordinate and work with your trusted financial adviser to ensure the proper management of your finances and assets. Sometimes, case managers, caregivers, medical providers, or other elderly service providers recognize that their patients may be declining, caught in the middle of family disputes, and/or in need of assistance with their finances, especially if there is no local family or other support. In these situations, MaxCorp may be contacted to assess whether MaxCorp can step in to provide administrative and fiduciary services to the patient. If you are a case manager, caregiver or geriatric service provider and recognize a need for one of your patients, please contact us to see if MaxCorp may be able to assist.
At other times, families may be caught in litigation and disputes as to who may be the most appropriate person to serve as Successor Trustee, Successor Personal Representative or Conservator/Guardian. When there are conflicts, sometimes it is best to have a neutral third-party step in. In some situations, the Court may refer the cases directly to MaxCorp by appointing MaxCorp to serve as Successor Trustee, Successor Personal Representative or Conservator/Guardian. In other situations, the parties, through their attorneys, may decide to stipulate and agree to appoint a neutral, independent third-party, like MaxCorp, to substitute in as Successor Trustee, Successor Personal Representative or Conservator/Guardian. In some instances, public or government agencies may refer a case to MaxCorp. Some of these referrals may come from the State of Hawaii Office of the Public Guardian in which MaxCorp is requested to serve as Conservator. Other referrals may come from other non-profit agencies, such as Legal Aid of Hawaii or Volunteer Legal Services of Hawaii. Often these cases may be pro bono or low bono matters, and it is best to contact our office to confirm that we are available to take on these types of new cases.
